Abstract

Research This study enforcement law to violation right basic human rights (HAM) in Indonesia, with focus on weaknesses implementation of Law no. 39 of 1999 and Law no. 26 of 2000. Problem main covers weak institution enforcer law , lack of source power , and intervention politics . Research purposes is identify challenge in upholding human rights and evaluating effectiveness framework law , as well give recommendation For strengthen upholding human rights through legal reform , improvement capacity institutions , and protection witnesses and victims. Method used is study law normative with approach statutory and conceptual , involving analysis of legal norms , studies literature , and interviews human rights expert . Research result show nonconformity between law written and practice in the field , influenced by weaknesses institution enforcer law , lack of source power , and intervention politics . Study This emphasize necessity strengthening institutions , improvement source power , education and training , as well protection witnesses and victims, with support commitment strong politics​ For ensure effectiveness law.
